Terms of Use
Application
The following Terms and Conditions apply to all subscriptions for Access to the Internet (“Access”) over the USIC Fiber Optic Network (“Network”), as defined in the Fiber Optic Cable Internet Access Subscription Agreement/Service Level Agreement (“SLA”). The user by subscribing for Access to the Internet over the Network by executing an SLA and by accessing the Services agrees to abide by and be bound by the terms and conditions set forth below. Failure to abide by or comply with these terms and conditions shall entitle Provider to immediately terminate service and access to the System by the user, and to pursue any other legal remedies available to Provider at law or equity.
Payment for Service
The Term of all subscriptions are month to month (including subscriptions by which user elects to pay for extended periods in advance) unless otherwise provided by written agreement with Provider. All subscribers must provide for payment by debit to a valid credit card. Subscribers agree to pay for Service in advance for a minimum of one month of Service in advance for each successive month of Service and authorize Provider to charge the credit card account provided by to Provider until the subscription is terminated as herein provided. Provider reserves the right to terminate Service and to charge subscriber’s credit card account for any outstanding Termination Charges, Service Fees or Equipment in the month prior to the expiration date of said credit card unless subscriber shall provide evidence satisfactory to Provider of the renewal or extension of the expiration date of such credit card more than 30 days prior to the expiration date of the credit card. In addition, subscribers shall pay a SETUP CHARGE, if required by Provider, in advance of activation of the subscription and Service by credit card or a REACTIVATION CHARGE, if Subscriber’s Service has been suspended by Provider due to a violation of these Terms and Conditions. Subscriber agrees to pay all taxes, franchise fees, and other charges, if any, which are now or in the future may be assessed by any governmental authority for the Service or the Equipment provided pursuant to the SLA.
Prices
Subscriber agrees to pay the Subscription Fee and other Fees, if any, for the level of Service subscribed for by the Subscriber as indicated by Subscribe’s initials on the Price List attached to the Subscription Agreement. Subject to applicable law, Provider reserves the right to change the Services and Equipment and the prices for such Services and Equipment at any time, unless otherwise indicated on the Price List.
Non-Proliferation or Redistribution of Service
Subscriber agrees not to use its residential access to the Network for the purpose of providing hosting base access services such as web server ftp, game servers, streaming media servers, or similar high bandwidth consuming uses unless agreed to in writing by Provider. Subscriber shall not resell, redistribute or otherwise permit persons or entities other than subscriber, the family of subscriber, within the confines of subscriber’s residential location to which the Subscriber’s subscription is associated as reflected on the Subscription Agreement, access to the Network through its connection to the Network and its subscription. Provider reserves the right to terminate services to any User that violates this provision or uses its access to the Network in any manner that causes damages to the Network or impairs the level of service provided to other subscribers of Provider on the Network.
Termination or Denial of Service
By subscriber: Subscriber may terminate the Services by giving Provider written notice of termination no less than one (1) month prior to the date upon which subscriber desires to terminate service. If subscriber has rented Equipment from Provider, such termination shall not be effective until receipt by Provider of the return of the Equipment in operating order or payment by subscriber of the full original price for such equipment. By Provider: Provider may terminate service to any subscriber without notice if any user of subscriber’s Access privileges violates Provider’s acceptable use policy published on the Provider’s web site, subscriber fails to pay for any service, rental or purchase of Equipment in advance, or any user of Subscriber’s subscription violates these Terms and Conditions. Provider reserves the right to refuse to provide service to, or to terminate service to, any person, entity or subscriber that is delinquent in payments due Provider, does not provide adequate security for prepayment of fees acceptable to Provider, or is otherwise not in good standing with Provider in its sole discretion.
Failure to Return Equipment
Upon termination of service, Subscriber is responsible for the return of all equipment rented from USIC. Upon failure to return USIC router and/or switch, Subscriber will be charged $79.95 USD for non-Gigabit devices, and $199 for Gigabit devices. Upon failure to return Ravon VOIP ATA equipment (where applicable), Subscriber will be charged $129.95 USD. Fees are subject to change at any time, unless otherwise specified.
Payment Expiration Date
If your Payment Method reaches its expiration date and you do not edit your Payment Method information or cancel your account, you authorize us to continue billing that Payment Method and you remain responsible for any uncollected amounts.

USIC Fiber Optic Network
Access Subscription Agreement/Service Level Agreement
1. Subscription
By executing this subscription agreement/service level agreement (“SLA”) for access to the Minneapolis/USIC fiber optic broadband IP date access network (“network”) and delivering it to provider the undersigned (“subscriber”) agrees to accept and abide by the terms hereof, the terms and conditions of subscription and the acceptable use policy of provider attached hereto and published on the provider’s web site.
2. Service Level
PROVIDER endeavors to have the Subscriber’s service available for access ninety-nine and nine-tenths percent (99.9%) of the time (“Availability”). For the purposes hereof service for access will be deemed available if access can be achieved on the Network from some point within the Subscriber’s location during some portion of a day, even if access is not available throughout the location. Provider shall not be responsible for the non-availability of Network Access due to failures on the part of Subscriber’s equipment.
3. Credits
In the event that service is totally unavailable throughout the Network for an entire 24 hour day due to a failure of Provider equipment, the Network, or a cause that could be controlled by PROVIDER, PROVIDER will credit to the Subscriber the monthly service charge for the Service at the rate of the fees attributable to the number of days during which Services were completely unavailable within the Network. In order for the Subscriber to receive a credit on its account, the Subscriber must promptly notify PROVIDER of the deficiency of Availability and request such credit within ten (10) business days after it experienced a lack of Availability. The Subscriber must request credit by sending an electronic mail message to PROVIDER by clicking on the “Contact Us” button on the website. For security reasons, the body of this message must contain the Subscriber’s account number, the dates and times of the unavailability of the Service, and such other Subscriber identification requested by PROVIDER. Credits will usually be applied within sixty (60) days of the Subscriber’s credit request. Credit to the Subscriber’s account shall be its sole and exclusive remedy in the event that there is no Availability.
4. Restrictions
Credit shall not be provided to Subscriber in the event that it experiences a lack of Availability resulting from (i) scheduled maintenance as posted from time to time at sign-in page of the website; (ii) Subscriber’s behavior or the performance or failure of its equipment, facilities or applications, or (iii) circumstances beyond provider’s reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of Subscriber’s Service. Subscriber agrees not to use its residential access to the Network for the purpose of providing hosting base access services such as web server ftp, game servers, streaming media servers, or similar high bandwidth consuming uses unless agreed to in writing by Provider. Provider reserves the right to terminate services to any User that violates this provision or uses its access to the Network in any manner that causes damages to the Network or impairs the level of service provided to other subscribers of Provider on the Network.
5. Limitation of Liability
Provider shall not be liable, for any indirect, incidental, special, or consequential or punitive damages or damages for loss of profits, lost revenue, lost data or any damage resulting from an inability or limited ability to utilized the Network, incurred by Subscriber or any third party, whether in any action in contract, tort, or breach of warranty, even if Provider has been advised of the possibility of such damages. In any event, Provider’s maximum liability to Subscriber shall not exceed the revenue received by Provider from that Subscriber in the one year preceding any claim.
Authorization to Act as Agent
The above fields provide a complete listing of Telephone Lines to be switched to US Internet Corp. By signing below, I am authorizing US Internet Corp. to become my new provider of long-distance service and/or local toll service (if available and selected by me). I authorize US Internet Corp. to act as my agent to make this change happen, and direct my local company to work with US Internet Corp. to affect the change. I understand it is my responsibility to consult with my current carrier as to whether a fee will apply to change to my preferred carrier. If I later wish to return to my current telephone company, I may be required to pay a reconnection charge to that company.
Change Authorization Verification
I certify that I am at least eighteen years of age, and that I am authorized to change telephone companies for services to the telephone numbers listed above. I am responsible for all valid US Internet Corp. charges for all usage.
Endorsing this document will result in a provider change!
About These Terms
We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at these terms regularly. We’ll post notice of modifications to these terms on this page. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.
